Tradeplace B.V. (“Tradeplace”) respects and is dedicated to honouring the preferences of
Users concerning the collection, storage, access, and use of their personally identifiable data
collected online. This Privacy Policy is to inform you what Personal Data is processed by
using its Website and Services, how it is collected, to whom it is or may be disclosed, and
how it is used. Tradeplace expects to continue to develop mechanisms to enhance the User
experience on the Internet. In the interest of enhancing competition in the market, Tradeplace
also intend to facilitate access to and circulation of non-confidential information related to
white goods and other small home appliances.

By “Personal Data” we mean any information relating to an identified or identifiable natural
person, as further defined in the General Data Protection Regulation (EU) 2016/679.

Tradeplace uses all reasonable endeavours:.
to make sure that any information and Services made available on Tradeplace’s website (the
“Website”) will be used for purposes in compliance with applicable law;
to ensure that the Website and its Services are offered in compliance with this Privacy Policy and
the Competition Policy;
to provide her Services according to the general principles of a competitive market.

Types and reasons for data collection

Tradeplace is a joint-venture company incorporated by several manufacturers of appliances (“Manufacturers”) aimed at creating a common access, with single sign-on, to their internet portals. By using the Services or accessing our Website via a web browser at https://www.tradeplace.com/ (“Website”), including all related documentation and related services, Personal Data is processed by Tradeplace.

There is a variety of Personal Data that is processed when you use our Services and/or the Website. This Personal Data may be provided by you directly or it may be information that results from your use of the Website. Depending on the service you use, Tradeplace may collect the following personal data:
Name;
Address;
Email address;
Telephone number;
Profession;
Land registry;
Trade name;
Business address and postal address;
Chamber of Commerce number;
VAT number;

This information is gathered for the following main purposes:
Creating a User account to register with Tradeplace;
Logging in to the User account;
Sending newsletters “opt in / opt out”;
To establish the identity of the User. Business contact information such as name,
address and e-mail address shall be collected at User level during the registration
process.
– To effect posting of opportunities or related communications. These communications
may concern the update and development of the Tradeplace website.
– To provide future service and goods. This information comprises both contact
information and information related to products and services offered by Tradeplace
and the Manufacturers. This information is also used to provide Users with product
and service updates, changes in our usage policies and similar notices.
– To better tailor marketing to User needs. Information on Website use helps us to
create website content and navigation that is most relevant and user friendly to Users
and enhances the overall User experience.

In addition, as part of our efforts to provide Users with the ability to establish a connection with the portals of the Manufacturers, Tradeplace reserves the right to pass on information it holds relating to a User to the Manufacturer, and only to such Manufacturer whose Internet portal the User has accessed via the Website, for security, connectivity and marketing purposes.

Through the Website and/or Services, Personal Data provided by the User will be used to enable Users to use all the functionalities, features and benefits of our Services.

Except as provided for in the next section, we will only share User Personal Data with our affiliated companies and external service providers. This means that User Personal Data may be transferred outside of the European Economic Area (EEA) to countries that may provide a lower standard of protection for your information. When we transfer User Personal Data outside the EEA, it will do so in compliance with applicable data protection laws and will ensure that User information is kept secure and the recipient has an adequate level of security. We will rely on appropriate contracts or suitable safeguards with recipients in countries outside the EEA to ensure User Personal Data is properly protected. We will not share User Personal Data with other persons or organizations, unless we believe in good faith that this is necessary to protect our rights, protect User safety or the safety of others, investigate fraud, respond to a government request or otherwise exercise our legal rights or defend against legal claims; and when we believe it is necessary to share information in order to assist in an investigation regarding, or to prevent, illegal activities, suspected fraud, or situations involving potential threats to the safety of any person.

User Rights and Choices
In accordance with the General Data Protection Regulation (GDPR), Users have the:

Right of acces
Users may contact us to get confirmation as to whether or not we are processing Personal Data concerning Users. Where that is the case, we will inform the User about the categories of Personal Data we process, the processing purposes, the categories of recipients to whom Personal Data have been or will be disclosed and the envisaged storage period or criteria to determine that period. This does not apply however to the information related to the company, which can only be modified by the company’s authorised User. The right of access includes, but is not limited to, the ability to update Users profiles.

Right to rectification
Users have the right to have inaccurate or incomplete Personal Data, we store about the User, rectified or completed.

Right to object
In case our processing operations are based on a legitimate interest of us, Users have the right to object at any time against these processing operations. We will then no longer process User’s Personal Data, unless we demonstrate compelling legitimate grounds for the processing that override your interests, rights and freedoms or for the establishment, exercise or defence of legal claims.

Right to restriction of processing
Users have the right to obtain from us restriction of processing his/her Personal Data in specific situations as foreseen by applicable data protection law (e.g. when the accuracy of your Personal Data is contested by User, for a period enabling us to verify the accuracy of your Personal Data).

Right to erasure
Users have the right to ask us to erase your Personal Data from our systems if the Personal Data are no longer necessary in relation to the purposes for which they were collected or otherwise processed. Furthermore, Users have the right to erasure if you exercise your right to object as meant above, unless we have an overriding legitimate ground to not erase the relevant data. We may not immediately be able to erase all residual copies from our servers and backup systems after the active data have been erased. Such copies shall be erased as soon as reasonably possible.

Right to data portability
Users have the right to receive your Personal Data in a structured, commonly used and machine-readable format and/or request that we transmit those data to a third party where this
is technically feasible. Please note that this right only applies to Personal Data which Users have
provided to us.

User Preferences
Use of the Website is voluntary. Participation requires Users to provide the
information specified in the registration screens for reasons specified and as provided in the User
registration agreement. This information is essential to properly complete the registration process.

Collection of Information using cookies
Tradeplace uses cookies to collect information on
the use of the Website by its visitors and to simplify return visits by Users. A cookie is a small piece of information sent by a web server to be stored on a web browser so it can later be read back from that browser. The information collected from cookies is used to improve the functionality of the Website. The information on the Website is organized and presented based on our analysis of the aggregate usage of the Website. Cookies are also useful in allowing for a more streamlined log-in for Users, tracking of shopping cart additions and in preserving order information between sessions. As we enable further customization on the user experience, cookies will play an integral part in assuring that information provided to Users will reflect their preferences and be most relevant to their needs. Tradeplace is concerned with the security of the personal data that are collected and has put in place measures to prevent unauthorised access to that information. We have taken precautions to protect the Website, Personal Data and information under our control from misuse, loss, or alteration. Our security measures include: Secured website;

  • Tradeplace uses industry standard technology and equipment to help protect Users’ registration information.
  • Tradeplace ensures that Personal Data is safe by using only encrypted network connections;
  • SSL certificate;
  • Encrypted database;
  • Tradeplace uses encrypted passwords;
  • Monitoring the platform on errors and traffic;
  • Tradeplace has taken physical and digital measures for access protection of the
    systems in which Personal Data is stored.
  • Tradeplace secures its Website and Services with firewall protection, password
    encryption, and restricted server access.

Unfortunately, no system can ensure complete security and User should take steps to protect User information and transmissions. User must decide the security measures that are appropriate; however, common examples are keeping your login identification and password secure and making sure you completely log out when you have finished using the registered user section of the Website.

Updates to the Privacy Policy
Tradeplace is sensitive to Users’ privacy issues and recognises the need to update this policy as new features and business services are offered on the website. All registered Users will be notified of any changes to the Privacy Policy prior to the change date.

Seller's Privacy Responsibilities
Tradeplace is not responsible for the actions of the Sellers and does not guarantee the privacy of data provided by or on behalf of a User to a Seller.

Data Security Policy

Tradeplace has various security measures in place to prevent the loss, misuse and alteration of information made available through the Service and under Tradeplace control. These measures include firewall protection, password encryption, and restricted server access.

However, none of these measures are foolproof or guaranteed and may not prevent the loss, misuse or alteration of information. Therefore, Tradeplace urges the Seller to exercise caution while using the Service.

Seller shall have the right, at Seller’s expense, to require an audit Tradeplace’s security procedures, however, only to such extent as specific information of the Seller is concerned. The audit shall be carried out by an independent third party appointed by the Seller. Seller may only appoint auditors from internationally recognized firms of good reputation such as Ernst & Young, KPMG, or firms of similar size, experience and reputation. Tradeplace may require the auditor to sign a reasonable confidentiality agreement, and in any event, the auditor shall agree that it will not reveal any User information to the Seller with the exception of information relating to the access by specific Users to the Seller’s web sites or computer systems. The auditor shall use reasonable efforts to avoid significant disruption of Tradeplace’s day-to-day business. Tradeplace agrees cooperate with such an audit.
